At present, the corruption case against the DPS CGHS MC is supposed to investigate corruption of crores of rupees which have been allegedly swindled by the MC members.

It is an open secret now that DPS CGHS is among the most corrupt housing societies of Delhi and the names of its managing committee (MC) members appear as history-sheeters (accused in multiple crimes) in many police and government records.

While these DPS CGHS MC members have already been convicted and punished by the court, they are facing many other investigations for their crimes and corruption which may lead to their imprisonment.

However, they are shamelessly breaking many other laws and trying to extort public money worth crores of rupees by threatening the members of the society. In the series of their crimes, the criminal DPS CGHS MC members – along with their accomplices including dishonest society members and felonious construction companies – have now embarked upon a floor area ratio (FAR) construction work in the society building.

Although the MC members claim that they have approvals from DDA and others, they are telling blatant lies because most members who are paying money for FAR construction and repairs have not read the so-called approval letters carefully. 

The MC does not have any approval letter. Rather, these are only conditional letters with objections and observations because MC has given wrong undertakings and flawed drawings at DDA for getting approvals illegally because FAR is not viable at DPS CGHS building.

The members who oppose FAR construction and repairs have full record of MC’s fraud that it has committed to get conditional FAR letters from DDA and others. These members will file a court case when the construction has begun at the building so that the people who have paid money for construction or repairs lose their money besides facing prosecution. 

Thus, the construction and repairs work will stop at DPS CGHS like it has stopped in the case of R.D. Apartments of Dwarka in an ongoing case [W.P.(C) 286/2018] at the Delhi High Court. At that time, the DPS CGHS building will become a disputed property for which the MC members, construction companies, and the members who paid money will be held responsible.

Extortion at DPS CGHS

But now the DPS CGHS MC is cheating the members to extort their money. For this illegal project, they are forcing and intimidating each member to pay lakhs of rupees. The DPS CGHS members who are paying money for this FAR construction and repairs are also willfully participating in the crime. 

They do not realize a simple fact that the DPS CGHS MC is facing supersession (termination) proceedings under Section 61 of the DCS Act at the RCS Court for a corruption case. The members should know that if the MC is terminated, the FAR construction and repairs project will get stopped before completion. 

In the last court hearing on June 6, the judge at the RCS Court clearly stated that the financial inquiry against the DPS CGHS MC members cannot be stopped because there is enough prima facie evidence of corruption against the MC members. 

Although the court has asked the MC to file a written rejoinder stating why it wants to obstruct the financial inspection, the MC is trying to deliberately delay the whole corruption case against it so that it could make more money in the FAR / repairs project before getting removed from the MC. 

FAR construction and repairs have been fraudulently clubbed by the MC while there is no distinction between construction and repairs. People who are paying money for repairs are, in fact, paying money for FAR construction. The total construction and repairs cost should be around Rs. 2 lakh per flat, but the MC is demanding more than Rs. 12 lakh from each member and later the cost will increase to touch even Rs. 20 lakh or more for each flat. It is a case of extreme corruption. 

At present, the corruption case against the DPS CGHS MC is supposed to investigate corruption of crores of rupees which have been allegedly swindled by the MC members. The very fact that the MC members are trying to oppose the inquiry ordered by the RCS Court proves that the MC members want to hide the financial records which show their criminality.

While in an ongoing case, the DPS CGHS MC members have been convicted and punished by a labour court, another case about their corruption is in progress at the Court of Financial Commissioner (a superior authority to RCS).

Moreover, a sanction petition has been filed in the RCS Court for filing a criminal case against the accused DPS CGHS MC members in the external / higher courts so that they could be immediately prosecuted and punished.

As the accused DPS CGHS members are being investigated for serious crimes, they have roped in more members on whom they could put the blame. For example, they have expanded their gang by creating a “Strategy Planning Group” with members who are supporting the accused MC members in the FAR construction-cum-repairs crime.

They are now together looting the members in the FAR fraud of an estimated Rs. 15 crore. It is also expected that after collecting the money for FAR construction and repairs, the MC members and a few others from the so-called “Strategy Planning Group” will abscond (run away) with the looted money in order to avoid government inquiries and possible jail sentence.

It is believed that DPS CGHS MC members are trying to surreptitiously influence the corruption inquiries against them by hook or by crook and possibly by bribing the government officials. With their mischievous tricks, the MC members may be able to delay their prosecution and possible imprisonment for some time. But they are expected to be caught sooner rather than later.

Recently, I took the DPS CGHS corruption case to the higher anti-corruption agencies to investigate the officers who may be trying to protect the accused MC members. As the inspection was getting delayed, I approached the Central Vigilance Commission (CVC) with facts of the DPS CGHS corruption case to get the inspection expedited so that the MC could be dismissed before starting further investigation in the case.

Under CVC’s direction, in May 2019, the Directorate of Vigilance, Delhi Government directed the Chief Vigilance Officer of Delhi Development Authority and Secretary (Cooperation), Cooperative Societies, Department of the Delhi Government to hold inquiries against the IAS officers who delayed the prosecution and termination of the DPS CGHS MC members in the estimated Rs. 20-crore scam.

As FAR construction / repairs is, in fact, another corruption scandal at DPS CGHS, members should not pay any money for this work. And those who have already paid money should demand their money back from the MC.
