Air India Man Sampathkumar Runs Criminal Gang in Delhi

In a short period of just a couple of years, Sampathkumar has established a full-fledged criminal enterprise that can soon challenge the dominance of D-Company.

Now, most of the people in Delhi and other parts of India know that DPS CGHS of Dwarka has become a veritable hideout for a gang of outlaws that operates under the garb of the managing committee (MC) of this housing society.

This gang is being led by M.N. Sampathkumar, who claims to be a former worker of Air India, which is the carrier airline of India under the Ministry of Civil Aviation. As the secretary of DPS CGHS, Sampathkumar is running a criminal racket that comprises nearly 40 members of the Society and others from the builders’ mafia.

It is being observed that in a short period of just a couple of years, Sampathkumar has established a full-fledged criminal enterprise that can soon challenge the dominance of D-Company with the title of his gang as S-Gang (or Sampathkumar’s gang). 

The activities of S-Gang include corruption, fraud, cheating, bribery, intimidation, illegal surveillance, breach of privacy, illegal car parking racket, labour rights violations, underhand dealings with vendors, environmental damage, defiance of court orders, contempt of court, obstruction of justice, and so on.

As a journalist and social activist, I have been complaining about the criminal activities of Sampathkumar and his gang. On the basis of the documentary evidence that I have submitted to the anti-corruption agencies, the government has ordered an investigation into the corruption case of DPS CGHS. The corruption money that Sampathkumar and his gang members have purportedly swindled is estimated to be Rs. 20 crore while the corruption is now increasing exponentially.

A few days ago, in a 50-page report (including 25 exhibits), I sent details of corruption and other crimes at DPS CGHS to specialized anti-corruption agencies of India. After accepting the details, the agencies have informed me that they are processing them for further action.

CORRUPTION AND LAWLESSNESS AT DPS CGHS

Besides a financial inspection ordered by the RCS Court under Section 61 of the DCS Act, 2003, the accused DPS CGHS MC members are also facing a case under Section 37 of the DCS Act, 2003 for the supersession (termination) of the MC under charges of large-scale corruption, impropriety, abuse of power, and other irregularities. 

Now, along with the RCS Court, the corruption case against DPS CGHS MC members has also reached the Court of the Financial Commissioner (FC Court) which is a higher court to the RCS Court and primarily deals with serious financial crimes. 

In its last hearing on July 30, 2019, the FC Court had asked the RCS (Registrar Cooperative Societies) office to explain why it is delaying the inquiry into “financial and other irregularities” at DPS CGHS. The next hearing in which the RCS office has to submit its explanation in the FC Court is on September 5, 2019. 

While the financial inspection ordered by the RCS Court is imminent, it will not be sufficient to frame specific charges against the DPS CGHS MC members because they are misusing their positions to tamper with the records that are supposed to be inspected and threatening the key witnesses as well as petitioners who have complained against them. 

So, the conventional inspection ordered by the RCS Court cannot be fair. Therefore, now I am demanding a forensic audit with special inquiry by specialized departments that deal with economic offences and financial crimes to find out the extent of crime and corruption at DPS CGHS. Also, the inquiry must begin after taking the DPS CGHS MC members and their accomplices into police custody.

While the anti-corruption agencies have accepted the proof that I have given about the corruption and other crimes by Sampathkumar and his gang, these gang members will be interrogated at the trial stage of the case after filing a charge sheet. 

I am urging the police and law-enforcement agencies to expeditiously start the process of filing a First Information Report (FIR), charge sheet, trial proceedings, and conviction in the DPS CGHS case, as there is sufficient prima facie evidence to start this judicial process.

COMPLAINT TO MINISTER

As Sampathkumar claims that he worked with Air India, on August 21, 2019, I informed the Minister of Civil Aviation about Sampathkumar’s illegal activities so that his strides in the world of crime could be checked.

Dear Mr. Puri,

I am a national award-winning journalist and founder of the humanitarian organization RMN Foundation. Earlier, I have also worked with the United Nations (UN) through United Nations Industrial Development Organization (UNIDO) as a digital media expert.

This is in continuation to my previous emails that I have written to Mr. Suresh Prabhu and Mr. Jayant Sinha (former ministers) in which I have informed that M.N. Sampathkumar – who claims to be a former employee of Air India (AI) – is facing multiple government-instituted inquiries including a corruption inquiry into an estimated Rs. 20-crore scandal.

Currently, as the secretary of DPS CGHS (DPS Cooperative Group Housing Society, Plot No. 16, Sector 4, Dwarka, New Delhi 110 078) Sampathkumar is member of a gang which is involved in a number of illegal activities such as misappropriation of public money, labour rights violations, bribery, deceptive tendering, illegal surveillance, and criminal intimidation. 

Now, along with his gang members, Sampathkumar has started an illegal construction project in the Society building for which he is threatening each resident / member to pay lakhs of rupees while the illegal construction project is of an estimated Rs. 15 crore. With lethal dust and noise pollution, this illegal construction work is posing serious accident risks to hundreds of people – men, women, children, and senior citizens – who are living in the building.

In view of these facts, I request you to get a formal departmental inquiry started against Sampathkumar so that his strides in the world of crime could be checked immediately. He should also be suitably punished and instructed to stay away from all illegal activities.

As this is also a case of rampant corruption, as a government minister you are requested to take immediate action in order to get the DPS CGHS case fully investigated. Please let me know the specific action that you are taking in this case.

ONGOING INVESTIGATIONS

The prosecution, conviction, and arrest of Sampathkumar and his gang are getting delayed because the justice delivery system in India is slow. However, you can see that police and law-enforcement agencies are regularly visiting the Society premises to question the DPS CGHS MC members. Also, the police and law-enforcement agencies are regularly informing me about the progress of their investigations into the cases of corruption and lawlessness at DPS CGHS.

I have also been complaining about the other crimes of Sampathkumar’s gang to police and law-enforcement agencies. Recently, I had called the inspectors from the labour court of Delhi to interrogate the DPS CGHS MC at the Society premises. 

As this was a serious case of labour rights violation (and corruption in hiring security services), the labour court issued summons to the DPS CGHS MC members and they were repeatedly called as criminals in the court. 

With reference and support from the National Human Rights Commission (NHRC), Delhi Government’s Home (Police) Department, and the Labour Minister of the Delhi Government, I personally went to the labour court to explain the case. 

The court penalized the DPS CGHS MC members who criminally used the Society (public) funds to pay the penalty for the crime that they themselves had committed. Now, I have reported it as an additional case of misappropriation of public money by Sampathkumar and his gang, while the case is still in court.

Despite the investigations and court cases, Sampathkumar and the key members of his gang (including Neeraj Kumar Vaish, R. Balasubramanian, Leela Swami, Sandeep Taneja, Manguram Tyagi, and Naseem Afshaque) are striving to expand their criminal cartel. 

In this direction, they have formed a local syndicate in the form of a Strategy Planning Group (SPG) which is supposed to make criminal strategies to support Sampathkumar’s gang in a new illegal construction project worth crores of rupees.

According to the MC documents, the members in this SPG are: Dilip Rozekar, Col. M.M. Shukla, C.B. Swami, Kulsheshtra, Ravinder Sharma, O.P. Khanduja, Manish Bisht, Kaushik Banerjee, Narender Kumar, L.S. Thakur, Gaurav Sood, Sunil Bansal, Dr. Alok Varshney, Vineet Dua, Kashmera Randhawa, and Vikash Sharma.

The DPS CGHS MC also claims that the petitioners Mr. Davinder Wazir (Flat No. 123), Ms. Anita Bhagat (Flat No. 401), Mr. K.V. Varghese (Flat No. 313), and Mr. H.L. Kaul (Flat No. 121) have also decided to support the crimes as they have withdrawn from the ongoing RCS Court case against the MC. Presumably, these members have been either bribed or threatened by the MC to join the gang. 

It is learnt that in order to establish an inter-state crime network, one of the members of the DPS CGHS gang has started implementing the DPS CGHS corruption model in a housing society in Jammu. I am getting in touch with authorities and anti-corruption agencies in Jammu to pursue this case.

Moreover, the MC documents reveal that for illegal construction work, the gang members have hired a number of external firms without following the proper tendering / purchase processes. The firms are Vivek & Arti Architects, Om Star Constructions, Design N Design Architects, and Team Professional Consultant and Resource Managers. 

All these cases of financial frauds are being reported to the investigating agencies so that the prosecution and imprisonment of DPS CGHS MC members and their gang members could be expedited.

EXTORTION AND THREATS

As they are behaving like hardened criminals, Sampathkumar and his gang members are terrorizing the innocent residents / members of DPS CGHS with frequent threats. They are forcing each member to pay lakhs of rupees for an illegal construction / repairs project that they started fraudulently in July 2019. 

The gang is also intimidating those members who are complaining against their crimes. Sampathkumar is using expulsion notices as threat weapons to silence those who raise their voice against his gang’s crimes. 

Of late, Sampathkumar, along with his gang members, sent notices to expel some members from the Society. These target members include the complainants and petitioners who have filed cases against their crimes. The criminality of Sampathkumar’s gang can be assessed from the fact that it also sent expulsion notices to two senior citizen women to harass them because they oppose the scandalous activities of Sampathkumar’s gang.

Obviously, now criminal intimidation by Sampathkumar and his gang is added to the list of their crimes while these cases are being reported to the authorities.

As Sampathkumar and his gang members have brought disrepute to DPS CGHS and tarnished the Society’s image everywhere with their nefarious activities, they must be disqualified and expelled from the Society by the RCS as per DCS Act / Delhi Cooperative Societies Rules before starting the criminal proceedings against them. 

While their threats to innocent members are increasing, I am also facing repeated threats from Sampathkumar and his gang because I have been raising my voice against their corruption and lawlessness. These threats include false police complaints against me, threats of physical harm to me, expulsion notices, legal notices, arbitrary financial penalties on me, and slanderous attacks on my social as well as professional status. 

But I am not deterred and I will keep fighting truthfully against the crimes and corruption of Sampathkumar and his gang to get the culprits arrested and imprisoned.

In order to stop the incidents of crime at DPS CGHS, the police and law-enforcement agencies are being approached to file an FIR in this case, arrest the accused DPS CGHS MC members for interrogation, frame specific charges against them for further prosecution, and stop all the illegal activities at DPS CGHS.
