The office of DDA Commissioner has asked Delhi Police Commissioner to investigate the criminal activities including property grabbing of S-Gang which operates under the cover of DPS CGHS MC.
First, the DPS CGHS MC members were involved in some petty corruption cases. Then they started behaving like street goons to harass the residents. Subsequently, they became criminals to commit a range of crimes. Now, the DPS CGHS MC members have formed a full-fledged gang called S-Gang comprising nearly 40 criminals who commit blatant crimes under the leadership of gang leader M.N. Sampathkumar.
A harassed Kashmiri migrant Davinder Singh Wazir has urged the Delhi Police to file a First Information Report (FIR) against the DPS CGHS MC members who have formed the S-Gang under the gang leader Sampathkumar.
In order to stop the crimes of Sampathkumar gang (or S-Gang), the Delhi Police, law-enforcement, and anti-corruption agencies are working actively to nab the S-Gang members.
As the S-Gang* members are trying to illegally grab the flats of residents, the Delhi Development Authority (DDA) has urged Delhi Police to investigate S-Gang’s involvement in the property grabbing crime.
In a letter dated 14.10.2019, the office of the DDA Commissioner has asked Delhi Police Commissioner to investigate the criminal activities including property grabbing of S-Gang.
As part of its criminal plan to illegally grab the flats of other owners, S-Gang has started an illegal and harmful construction project in the DPS CGHS building so that people should leave their flats in panic.
The gang members are also threatening residents to extort their money for the illegal construction project estimated to be of Rs. 15 crore while the Sampathkumar gang members are already facing government inquiries in a Rs. 20-crore corruption scandal.
As part of its investigation, Delhi Police is supposed to check the illegal construction activity in the building and S-Gang’s collusion with DDA and other departments to extort public money for the harmful construction project.
As a journalist and social activist, I had complained against the S-Gang to the Ministry of Housing and Urban Affairs (MoHUA), Govt of India, which controls DDA and its corruption.
The police investigation will also cover the corrupt practices that the S-Gang members used to get their flawed drawings approved from the DDA and other authorities, and the umpteen violations they have committed during the floor area ratio (FAR) construction work.
Formed by M.N. Sampathkumar – who claims to be a former employee of Air India – Sampathkumar gang (or S-Gang) is committing a range of crimes including corruption, fraud, cheating, extortion, bribery, intimidation, illegal car parking racket, labour rights violations, underhand dealings with vendors, and so on. With its current focus on property grabbing, S-Gang operates on the lines of infamous D-Company to occupy other residents’ flats.
THREATS BY SAMPATHKUMAR GANG
Since most DPS CGHS residents were not in favour of harmful construction, they refused to pay money for the construction work and even filed a legal case in the Court of Registrar Cooperative Societies (RCS) for the termination of S-Gang members under corruption charges.
As the RCS Court found that there is sufficient prima facie evidence of corruption, it has ordered a financial inspection under Section 61 of the DCS Act, 2003 against the S-Gang members who operate as DPS CGHS MC (managing committee) members.
Now, the S-Gang members are openly threatening members to pay lakhs of rupees for the illegal construction work and also threnating those who have filed legal cases against their crimes.
Davinder Singh Wazir – a Kashmiri migrant – who is the main petitioner in the corruption case filed against the Sampathkumar gang at the RCS Court is particularly being harassed by the S-Gang members.
The S-Gang members forced him to pay lakhs of rupees for the harmful and illegal construction and also threatened him to withdraw his case from the RCS Court.
In his complaint to the Delhi Police, the National Human Rights Commission (NHRC), and other government departments, Wazir (pictured above) urged the police to file a First Information Report (FIR) against the DPS CGHS MC members, including Neeraj Vaish, R. Bala Subramanian, M.N. Sampathkumar, Ms. Leela Swami, Sandeep Taneja, Manguram Tyagi, and Ms. Naseem Afshaque.
Wazir (Flat No. 123) alleges that the MC members hate him and treat him like an untouchable refugee because he belongs to the Kashmir region. He also said in his complaint that the MC members also have attacked his freedom of expression and speech, as he has been opposing the malpractices of the MC members.
PROPERTY GRABBING BY S-GANG
However, the threats of S-Gang to Wazir and others continued. The S-Gang filed a false police complaint against Wazir with the allegation that he is an anti-national from Kashmir, and he is not even a citizen of India. With the false police complaint, the S-Gang tried to drive Wazir out of the society with the aim to illegally grab his flat.
Wazir got so terrified that he paid the money for illegal construction in order to save his flat from the evil hands of S-Gang. It is also learnt that under S-Gang’s threats, he has withdrawn his name from the RCS Court case against the S-Gang.
Similarly, the S-Gang is threatening other society members so that they should vacate their flats or pay lakhs of rupees for illegal construction. For example, it is learnt that K.V. Varghese (Flat No. 313) and H.L. Kaul (Flat No. 121) who are also petitioners in the RCS Court case against the DPS CGHS MC members have paid money for illegal construction and it is stated that – like Wazir – they have also withdrawn their names from the court case.
The names of Varghese and Kaul appear in the S-Gang members’ corruption cases as they were MC members in previous MCs controlled by the current MC members who are under corruption investigations. It is also learnt that both Varghese and Kaul have assets disproportionate to their known sources of income, and they have built properties in other states of India.
Sources reveal that both Varghese and Kaul have amassed huge ill-gotten wealth from their previous jobs in a Delhi school and in a government engineering department in Jammu, respectively. Recently, I have informed about both of them to the anti-corruption agencies so that they could be asked to declare their assets in Delhi and other places.
Along with S-Gang members, now all these hostile petitioners – Wazir, Varghese, Kaul, and others – are targets of the government investigation into the crime and corruption at DPS CGHS. By giving protection money in the form of construction / repairs charges to the S-Gang, they may have saved their flats, but now they have become part of the illegal scheme being run by the S-Gang. They are also conspiring with the S-Gang members to harm other members who are opposing the crimes of S-Gang.
The S-Gang members are purportedly forcing the residents to vacate their houses after starting the lethal construction project in the building. Some residents have already started leaving their houses in panic caused by the S-Gang.
Moreover, in a flagrant crime to control the sales of flats, the S-Gang has put a notice board at the gate of the DPS CGHS building with a criminal diktat that the residents who want to run away will not be able to sell their flats without S-Gang’s permission.
In order to grab residents’ flats under distress sales (sales at significantly lower prices), some of the S-Gang members are operating as property agents to buy the flats at lower rates. Some of these S-Gang members already own multiple flats.
It is also learnt that an RCS official – who now lives at DPS CGHS – is supporting the crimes of DPS CGHS MC members and protecting them in the corruption inquiries that they are facing at the RCS Court. He is, therefore, a part of the crime and corruption racket being run by the S-Gang. I am in the process of exploring his involvement in the crimes.
VIOLENT BEHAVIOUR OF THE S-GANG MEMBERS
Since most flat owners are scared of the violent behaviour of the S-Gang members, they do not raise their voice against the nefarious activities of the gang. A few days ago, however, a society member Abdul Jamil Urfi mustered some courage to challenge the tyranny of the S-Gang.
In his letter written to the gang leader Sampathkumar, the flat owner Urfi raised a number of concerns related to the environmental damage and health risks posed by the harmful construction that the S-Gang has started. He also revealed that his tenant was vacating the flat because the DPS CGHS flats are not safe for living as risky construction is happening in the building.
The residents who are not leaving their flats are getting injured in the life-threatening construction started by the S-Gang and some residents are getting hospitalized with serious injuries inflicted by the illegal construction started by the S-Gang members.
The gang members have also colluded with the corrupt officials of IGL (Indraprastha Gas Limited) to break gas pipelines repeatedly and stop gas supply to flats so that people should run away under the fear of a possible fire mishap in the DPS CGHS building so that the gang members could steal their flats.
Earlier, with its letter dated 30.08.2019, the RCS office had issued a notice to the S-Gang (or DPS CGHS MC members) asking the gang members to explain why they broke the gas pipelines and criminally stopped gas supply to the flats during the illegal FAR construction. The S-Gang could not give any satisfactory response to the RCS office while the case is being further investigated.
As they are behaving like hardened criminals, Sampathkumar and his gang members are terrorizing the innocent residents / members of DPS CGHS with frequent threats in order to illegally grab their flats.
They are forcing each member to pay lakhs of rupees for the illegal construction / repairs project that they started fraudulently in July 2019 and stated that it will run for many years in the occupied building where hundreds of people are living. The gang is also intimidating those members who are complaining against their crimes.
Gang leader Sampathkumar is using expulsion notices as threat weapons to silence those who raise their voice against his gang’s crimes. Of late, Sampathkumar, along with his gang members, sent notices to expel some members from the society so that the gang could usurp their houses.
These target members include the complainants and petitioners who have filed cases against the S-Gang’s crimes. The criminality of Sampathkumar’s gang can be assessed from the fact that it also sent expulsion notices to two senior citizen women to harass them because they oppose the scandalous activities of Sampathkumar’s gang.
In a recent signed representation, the DPS CGHS residents have said categorically that they do not want FAR construction, etc. in their society building. They say the FAR construction is spreading harmful dust and noise pollution and causing extreme disturbance including accidents such as breaking of IGL gas pipeline and possibility of fire mishaps in the society building.
The residents also reveal that the DPS CGHS MC or S-Gang has mercilessly destroyed the green parks where children used to play, is breaking the houses without owners’ permission, and demolished the entire building with FAR construction which will run for many years if not stopped immediately.
The residents said in the representation that it has become almost impossible to live in the ruined building. Therefore, they urge the authorities to immediately stop FAR construction at DPS CGHS building where people – including men, women, children, and senior citizens – are living.
S-GANG HEADQUARTERS AT DPS CGHS DWARKA
Currently, S-Gang operates from its headquarters at DPS CGHS building in Sector 4 of Dwarka. As the secretary of DPS CGHS MC, Sampathkumar is running a criminal racket that comprises nearly 40 members of the society and others from the builders’ mafia.
While DPS CGHS MC secretary Sampathkumar (Flat No. 151) works as the ganglord , the other S-Gang leaders in the MC include Neeraj Kumar Vaish (Flat No. 153), R. Balasubramanian (Flat No. 322), Leela Swami (Flat No. 173), Sandeep Taneja (Flat No. 473), Manguram Tyagi (Flat No. 133), and Naseem Afshaque (Flat No. 172).
As their criminal activities have been expanding dramatically, the S-Gang members have roped in a number of other DPS CGHS members who are actively participating in the S-Gang’s crimes. In my complaints submitted to the law-enforcement agencies, I have included more names of members who are supporting the illegal activities of the S-Gang.
These are Dilip Rozekar (Flat No. 111), M.M.Shukla (Flat No. 112), C.B. Swami (Flat No. 173), Pranav Kulshreshtha (Flat No. 163), Ravinder Sharma (Flat No. 113), O.P. Khanduja (Flat No. 261), Manish Bisht (Flat No. 253), Kaushik Banerjee (Flat No. 273), Narender Kumar (Flat No. 233), L.S. Thakur (Flat No. 301), Gaurav Sood (Flat No. 223), Sunil Bansal (Flat No. 311), Dr. Alok Varshney (Flat No. 323), Vineet Dua (Flat No. 412), Kashmera Randhawa (Flat No. 431), Vikas Sharma (Flat No. 451), and R.K. Saggi (Flat No. 422).
The names of all these additional members of S-Gang appear in my complaints with their specific roles in the crimes while the corruption money involved at DPS CGHS is over Rs. 20 crore and corruption is increasing exponentially. This money will be recovered from the S-Gang members after their imminent indictment.
Also, the following external firms have been hired by the accused S-Gang members (DPS CGHS MC members) for the illegal FAR construction / repairs project without following the proper tendering / purchase processes. According to official documents, the firms involved in the project are:

CORRUPTION INVESTIGATIONS
Currently, the S-Gang members (or DPS CGHS MC members) are facing a financial inspection ordered by the RCS Court under Section 61 of the DCS Act, 2003 for corruption of an estimated amount of Rs. 20 crore.
In a new notice dated 30.09.2019, the RCS office has asked the S-Gang to send its reply within 15 days for the corruption inquiry ordered by the Directorate of Vigilance (DOV), which is the top anti-corruption department of the Delhi Government.
In another notice dated 30.09.2019, the RCS office has also asked the S-Gang to explain about the unlawful activities that the gang members are committing at DPS CGHS under the garb of the MC of the society. The S-Gang is again ordered to send its reply within 15 days.
Instead of properly replying to the government inquiries, the S-Gang members are trying to evade the government orders in an unscrupulous manner just to hoodwink the authorities. As S-Gang members are trying to hide their crimes, I am in the process of reporting the matter to the police and law-enforcement agencies.
The accused gang members are also facing a case under Section 37 of the DCS Act, 2003 for their supersession (termination) under charges of large-scale corruption, impropriety, abuse of power, and other irregularities.
In order to avoid the series of corruption inquiries, the S-Gang members may try to quit their MC positions and abscond. But the long arm of law will catch them. And the new members of the MC after election will be equally responsible for the crimes of S-Gang if they failed to get the S-Gang members prosecuted in order to recover the money that they have swindled.
Now, along with the RCS Court, the corruption case against DPS CGHS MC members (who operate as S-Gang) has also reached the Court of the Financial Commissioner (FC Court) which is a higher court to the RCS Court and primarily deals with serious financial crimes.
As I have submitted conclusive evidence against the S-Gang members to the anti-corruption agencies, soon the charge sheet is expected to be filed against them to proceed with the trial and subsequent prosecution.
Since the RCS officials are complicit in the crimes and corruption that is happening at DPS CGHS, they are delaying the inquiries. With such deliberate delays, the RCS officials are not only supporting corruption, but they are also giving an opportunity to the accused DPS CGHS MC members to misuse their positions to threaten the petitioners, influence the key witnesses, and tamper with the financial and other documents that are supposed to be inspected in the inspection ordered by the RCS Court.
Therefore, the inspection ordered by the RCS Court at DPS CGHS cannot be fair and genuine if the DPS CGHS MC members are not removed from their positions and taken into custody before starting the financial inspection. Moreover, since rampant corruption happens at RCS office, the DPS CGHS MC members may bribe the RCS officials to get the inspection in their favour. So, the findings of the inspection ordered by the RCS Court cannot be trusted.
In these circumstances, in my new complaints I have demanded a forensic audit by a specialized anti-corruption agency that will hold a thorough probe into the financial and other crimes at DPS CGHS. The findings of the forensic audit will form the basis for prosecution of the S-Gang members and their accomplices.
There may be judicial delays, but the Sword of Damocles will keep hanging over their heads, as I am working hard to get all S-Gang members (or DPS CGHS MC members) and their accomplices arrested and imprisoned.
